Mr. Ganguly, and Mr. Bhaattacharjee, learned advocates earlier appearing for the petitioners submit that they have no instructions to pursue the revisional application. Mrs. Aparna Banerjee, learned advocate appears on behalf of the Provident Fund Authorities.

I have perused the subject matter of the revisional application, which relates to quashing of case no. C/209 of 2007 under Section 14(2A) of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952.

I have perused the contention advanced in the revisional application, I am of the opinion that there are mixed question of facts and law which have been agitated by the petitioners before this Court. The said issues are to be decided in course of trial as the veracity of the documents relied upon as also the assertions must be proved by way of evidence. In view of the aforesaid, no interference is called for.

Accordingly, CRR 4192 of 2008 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
