Mr. Swakshar Kumar Mondal Mr. Jayatish Biswas ...for the Petitioner Mr. Suman Ghosh Mr. Chandan Chakraborty ...for the State Learned advocate appearing for the petitioner submits that petitioner approached this Court with prayer for taking appropriate measures in respect of investigation of Narendrapur P.S. Case No.1078 of 2023 dated 23.11.2023. However, in the meantime, the police authorities have concluded the investigation and submitted charge-sheet before the jurisdictional Special Court. In view of the change of circumstances, petitioner submits that the purpose of filing the writ petition has been sub-served.

As none appears on behalf of the State, Mr. Suman Ghosh, learned senior Government advocate along with a junior of his choice is directed to represent the State. Their appearances may be regularized. As the

police authorities have submitted the charge-sheet, petitioner being the de-facto complainant would be served with the copies of the documents on which the prosecution proposes to rely.

The petitioner would be at liberty to canvass further issues if dissatisfied with the investigation. On the other hand, if the petitioner is satisfied then in that case, the Trial Court is directed to proceed with the trial of the case after the stage of consideration of the charges. With the aforesaid observations, WPA No.29767 of 2024 is disposed of.

Parties to act on a server copy of this order duly collected from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be given to the parties, upon compliance of all requisite formalities.
