Ct.No.28 as (Rejected) C.R.M. (DB) 4832 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Joynagar P.S. Case No.631 of 2021 dated 16.09.2021 under Sections 363/365/368 of the Indian Penal Code read with Section 6 of the POCSO Act.
In the matter of : Parvin Kumar.
... Petitioner.
Mr. Ayan Bhattacharjee, Mr. Abhrajit Roy Choudhury.
...for the Petitioner.
Ms. Amita Gaur.
...for the State.
1.
Petitioner is in custody for one year and seven months. He submits that he had married the victim. Her examination is complete. Accordingly, he prays for bail. 2.
Learned Advocate for State opposes the bail prayer. 3.
We have considered the materials on record including the evidence of the victim. We note that the victim was detained and sexually exploited by petitioner. 4.
Keeping in mind the gravity of the offence, we are not inclined to grant bail to petitioner at this stage. 5.
Accordingly, the prayer for bail of petitioner is rejected.
6.
We request the trial court to conclude the trial at an early date preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
7.
Parties shall communicate this order to the trial court for due compliance.
