1. Learned Counsel for the petitioner submits he is in custody for 116 days. It is also submitted deceased had left her husband and was residing with the petitioner. Husband of the deceased had motive to commit the crime. Accordingly, he prays for bail.

2. Learned Counsel for the State opposes the prayer for bail and submits petitioner and deceased were living together in a flat. Dead body of the deceased was found in the flat. Statements of the neighbours show petitioner was in the flat on the fateful day and they quarreled with each other.

3. We have considered the materials on record. Petitioner and deceased used to reside together in a flat. On the fateful day petitioner and deceased had quarreled. Body of the deceased was recovered from the flat and cause of death is homicidal.

These incriminating circumstances prima facie establish involvement of the petitioner in the crime. Keeping in mind these facts and in view of gravity of the offence, we are not inclined to grant bail to the petitioner at this stage.
