The petitioners challenge the inaction on the part of the respondent Nos.1, 2 and 3, in not giving her the ensured amount in respect of several policies, taken out by her husband, who has presently expired on April 6, 2024. 3.

The Counsel for the respondent Nos.1, 2 and 3 has submitted that the self-same issue was carried before the Consumer Forum by the respondent No.4, being the mother of the late Prasenjit Mondal, the petitioner No.1's husband. The Consumer Forum, had also disposed of the matter by an order of May 6, 2022, which has been carried in appeal by the petitioners herein challenging the right of the respondent No.4 to receive the usufructs of the four policies taken out by her late husband.

It is not in dispute, rather admitted by the appearing parties that the self-same issue is pending adjudication before the State Consumer Disputes Redressal Commission. 5.

Records reveal that the appeal is indeed pending before the said Forum on the self-same cause of action.

6. In view of the aforestated, this writ petition cannot be entertained.

The writ petition is, accordingly dismissed.

8. There shall, however, be no order as to costs.
