1. Petitioners contend they had been assaulted and a criminal case was registered. In retaliation, they have been falsely implicated. They pray for anticipatory bail.
2. Learned lawyer for the State and the de facto complainant oppose the prayer.
3. We have considered the materials on record. Statement of the victim alleges petitioner no. 1 had raped her. In view of the nature of allegation we are not inclined to grant anticipatory bail to him.
4. Allegation against petitioner no. 2 is general and omnibus. Hence, we are inclined to grant anticipatory bail to him.
5. Accordingly, we direct that in the event of arrest, the petitioner no. 2 viz Selima Bibi @ Salema Bibi shall be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, to the satisfaction of
the Arresting Officer and also subject to the conditions as laid down under section 482(2) of BNSS 2023.
6. Petitioner no. 2 shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
