Mr. Kamalesh Bhattacharya, learned counsel appears for the petitioners.

Mr. Satyajit Talukdar, learned counsel appears for the respondent nos. 3 and 5.

Ms. Priyamvada Singh, learned State advocate appears for the respondent nos. 1 and 2.

The petitioners submit that out of 1.65 acres of land, a portion thereof comprising of 0.04 acres of land was acquired in connection with LA Case-II/105 of 19761977. The prayers in the writ petition shows that the petitioners claim demarcation of the acquired portion of

land so their unacquired portion can be segregated from the acquired portion.

The avernments made in paragraphs 1 and 2 to the writ petition shows that the petitioners claim ownership in respect of the said unacquired portion of land. In view of the above, the respondent no.2 is directed upon issuing a prior notice to the petitioners and respondent no.3 fixing the date and time therein shall cause a physical inspection of the acquired portion of land and then shall demarcate the acquired portion of land in accordance with law. The respondent no.2 shall prepare a report of demarcation along with a demarcation sketch map and shall furnish the same before the petitioners. The entire exercise shall be carried out and completed by the respondent no.2 positively within a period of four weeks from the date of communication of this order. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions, this writ petition, WPA 29975 of 2024 stands disposed of, without any order as to costs.
