This is an application under Section 24 of the Code of Civil Procedure.

Mr. Niladri Saha, learned advocate appearing on behalf of the petitioner submits that the parties have got their marriage dissolved by a decree of divorce on mutual consent and in view of such development the prayer of the petitioner for transfer of the matrimonial suit filed by the husband/opposite party for seeking divorce has become infructuous.

C.O. 4173 of 2017 is therefore dismissed as infructuous without any order as to costs.
