Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner was an employee of West Bengal Transport Corporation Limited, who retired on superannuation on 31st May, 2024.

It is submitted on behalf of the petitioner that petitioner was under contributory provident fund scheme and after retirement provident fund was released in favour of the petitioner belatedly as a result whereof petitioner prays for issuance of direction upon the concerned respondent authorities to release interest on provident fund dues.

West Bengal Transport Corporation Limited and State respondents are represented by learned advocates.

Since it is found that West Bengal Transport Corporation Limited caused delay in releasing provident fund, said authority is directed to pay interest at the rate of 6 per cent per annum on provident fund dues from the date following the date of retirement till the date of payment within a period of three (3) months from the date of communication of this order.

In the event concerned respondent authority fails to pay interest on provident fund dues in terms of the aforesaid directions within the stipulated time, respondent authority shall be required to pay 8 per cent interest per annum on deferred payment.

For making payment in terms of the aforesaid directions if fund is necessary to be allotted by the State respondents, steps shall be taken by the State respondents for allotting such fund.

With the above directions, writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
