Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an Assistant Professor at the Dr. B. R. Ambedkar College, Nadia. He has made applications seeking transfer to another college on certain grounds, lastly on 28th October, 2024. He has already completed five years of service and there is vacant seat for the post at the colleges where he had sought transfer namely, Vivekananda College at Alipurduar and Mathabhanga College, Cooch Behar. The application for transfer has not been decided yet.

Learned counsel appearing on behalf of the State submits that in the event an application is

pending consideration before the D.P.I. for transfer, the same would be considered in accordance with law.

In view of the above, the writ petition is disposed of by directing the concerned D.P.I. to consider the petitioner's application for transfer dated 28th October, 2024 in accordance with law and upon hearing the petitioner as expeditiously as possible, preferably within eight weeks from the date of communication of this order.

It is made clear that the merits of the case have not been gone into.

As affidavits have not been called for, allegations made would be deemed not to have been admitted.

Urgent Photostat Certified copy of this order, if applied for, be given to the parties upon complying with all necessary formalities.
