Kausik (Allowed) CRM (NDPS) 1726 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bishnupur Police Station Case No. 734 of 2024 dated 08.07.2024 under sections 21(c)/29 of the NDPS Act.

Learned advocate appearing for the petitioners submits that petitioners are similarly placed with the accused who has been granted bail in CRM (NDPS) 1600 of 2025 and the subject matter involved in the present case related to recovery of 7 litres of Codine Mixture from these petitioners along with the petitioner who has been granted bail. Petitioners are in custody for 1 year and 6 months and out of 17 witnesses proposed, one witness till date has been examined.

Learned advocate for the State opposes the prayer for bail.

However, having regard to the period of detention of the present petitioners and the parity claimed, I am inclined to release the petitioners on bail.

As such the prayer for bail of the petitioners is allowed. Petitioners, namely, (1) Pintu Mondal, (2) Biplab Mondal, (3) Provat Gayen @ Pravat Gayen, (4) Indrajit Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act) - cum - Learned Additional District and Sessions Judge, 12th Court, Alipore, South 24 Parganas.

If on bail petitioners shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of South 24 Parganas without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1726 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
