The petitioner alleges that an organisation called the Bhimpur Santi Committee is organising a cock-fight in the premises of Bhimpur Santal High School thereby disturbing the day to day activities of the school.
It appears from the report submitted by the State that the property in which the school is running belongs to the American Baptist Foreign Mission Society, New York and the said society runs the school. The report further reveals that the Bhimpur Santi Committee is organising a fair and associated cock-fight in a land which is neither owned by the school, nor situated within the school premises. The land in question is outside the boundary wall of the school. Learned counsel for the State submits that such programme has been continuing for last 150 years. The society as well as the relevant Government authorities have granted permission to the Committee to hold such programme.
Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the programme is being organised beyond the boundary of the
school, the same may be organised in a land beyond the said boundary in a manner so as not to disturb the day to day activities and functions of the school including the centenary celebrations of the school which was scheduled to be held from 23rd December, 2025 and shall continue till 25th December, 2025.
The committee shall conduct the programme in a peaceful manner so that neither the school nor the neighbours or the public at large are disturbed in any manner whatsoever. Sufficient police personnel shall be deployed at the spot to ensure strict maintenance of peace and tranquility. The organisers and participants shall not indulge in any activity which may affect the peace and tranquility of the area.
With the aforesaid observations and directions, the writ petition is disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
