The petitioner is the widow of a Gram Panchayat employee. The husband of the petitioner died-inharness on 19th July, 2023. The petitioner submits that she has been paid the gratuity and provident fund but she is yet to receive the pensionary benefit.

Learned advocate appearing for the State respondents has obtained instruction from the Block Development Officer, Joynagar-I and it has been submitted that the petitioner is required to submit an heirship certificate from the Collector/District Magistrate of the district disclosing the details of the heirs of the deceased.

As it appears that there is some amount which is due and payable to the petitioner on account of the terminal benefits of her deceased husband, accordingly, the Block Development Officer is directed to intimate the petitioner the formalities that she is required to comply for the purpose of obtaining the said terminal benefits.

The respondent no.7 shall intimate the petitioner the requirements and the formalities to be complied by her positively by 15th March, 2024. The petitioner shall be obliged to comply the necessary formalities. On receipt of the required documents, steps shall be taken for disbursing the pensionary benefit and other terminal dues of the deceased employee at the earliest.

Instruction forwarded by the Block Development Officer, Joynagar-I dated 29th December, 2023 is taken on record.

The writ petition stands disposed of.
