Kausik (Allowed) CRM (NDPS) 1730 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1049/2020 dated 23.12.2020 under Section 21(C)/29 of the NDPS Act and Section 18(b)/27(a) of the Drugs and Cosmetic Act.

Learned advocate appearing for the petitioner submits that he has been named in the supplementary charge sheet and there has been no recovery in the case so far as the present petitioner is concerned.

Petitioner was arrested pursuant to warrant of arrest issued and is in custody for 110 days.

Learned advocate for the State, on the other hand, opposes the prayer for bail but is unable to dislodge such contention regarding the petitioner being arrested on the basis of statement of co-accused.

Having regard to the aforesaid facts I am of the view further detention of the present petitioner is unwarranted. As such the prayer for bail of the petitioner is allowed. Petitioner, namely, Somnath Adhikari @ Banti shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act cum Learned Additional District Judge, 4th Court, Malda.

If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) 1730 of 2025 is allowed. Report submitted be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
