Learned advocate appearing for the petitioner submits that the petitioner is in custody since 23rd March, 2024 and the prosecution till date has examined 4 witnesses, although they have citied 14 witnesses to establish their case. There is no possibility of the trial being concluded in near future, learned advocate for the petitioner prays for bail.

On the other hand, learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement under Section 164 Cr.P.C. of the victim as well as the medical evidence which is appearing in the case diary as also the disability certificate.

Having considered the fact that prosecution is consuming time, but at the same time, considering the gravity of the offence, I am of the opinion that, as a matter of last chance, five months' time be granted to the prosecution to complete its witnesses. Learned

trial court would see that in case the petitioner co-operates in the progress of the trial of the case and yet the evidence of the prosecution witnesses are not concluded by 31st August, 2026, the learned trial court would be at liberty to grant bail of the present petitioner.

With the aforesaid observations, CRM(M) 185 of 2026 is disposed of at this stage.

Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
