During the course of submission, learned counsel seeks permission to withdraw the present petition with liberty to move an appropriate application before the learned trial court for withdrawal of the criminal complaint.

Learned counsel submits that the parties shall make deposit in terms of the Apex Court judgment of Damodar S. Prabhu vs. Sayed Babalal reported in (2010) 5 SCC 663. 3.

Liberty granted.

Petition is dismissed as withdrawn.

However, learned trial court is requested not to take any coercive action till the application for withdrawal of the complaint is filed.

Let the application be filed within the period of four weeks.
