SG [REJECTED] C. R. M. (A) 4474 of 2024 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Malda Police Station Case No. 180/2024 dated 01.04.2024 under Section 302 of IPC.

And In Re: Raj Kumar Mandal @ Bhodol.

... ... Petitioner Mr. Kazi M. Rahman.

......for the petitioner Mr. Rudradipta Nandy, ld. A.P.P.

Ms. Sanjana Saha.

...for the State 1.

Petitioner contends he has been falsely implicated out of mere suspicion. He prays for anticipatory bail. 2.

Learned Advocate for the State opposes the prayer for anticipatory bail.

3.

We have considered the materials on record. Statement of the deceased wife discloses enmity between the petitioner and the deceased. CDRs probabilise presence of the petitioner near the place where the victim was murdered.

4.

In view of the aforesaid incriminating materials and gravity of offence, we are of the opinion this is not a fit case to grant anticipatory bail.

5.

Application for anticipatory bail is, thus, rejected. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
