The report submitted by the Chief Judicial Magistrate, Darjeeling (Sadar) through the District Judge, Darjeeling on 18.07.2023 states that the G.R. Case No. 286 of 2014 had been committed to the Court of the learned Special Judge, 1st Court, Darjeeling on 13.08.18. The next date is fixed in the case for the evidence of CSW1. The Charge-sheet having been submitted, on the basis of which charge has been framed and the trial had been on the point of its initiation as extended to a considerable stage.

Under such circumstances, this Court does not find it prudent to interfere with the impugned order. However, the parties are at liberty to agitate their individual grievance before the trial court.

The concerned District Magistrate as well as Waqf to abide by its own jurisdiction Rules and Regulations The instant revisional application is disposed of.

Copy of the order be sent to the Department for information.
