The petitioner seeks extension of the time period of the recommendation letter issued in his favour by the West Bengal Central School Service Commission on November 22, 2024. The petitioner is a job loser who lost the job in view of the judgment delivered by the Hon'ble Supreme Court in Civil Appeal No.4800 of 2024 [State of West Bengal -vs- Baishakhi Bhattacharya (Chatterjee) & Ors.].

The petitioner prays for a direction upon the Commission to extend the validity period of the recommendation letter so that he may get an opportunity to join in a school.

The petitioner relies on the judgment dated November 25, 2025 in MAT No.1512 of 2025 with I.A. No. CAN 1 of 2025 (West Bengal Central School Service Commission & Anr. -vs- Arpita Pramanik & Ors.) wherein the Hon'ble Division

Bench directed the Commission to recommend the name of the subject candidate provided matching vacancy is available.

The aforesaid prayer of the petitioner is opposed by the Commission. It is submitted that the petitioner has approached the Court long after expiry of the statutory time period mentioned in the recommendation letter.

On a perusal of the judgment mentioned above, it appears that the submission made by the Commission was all considered by the Hon'ble Division Bench and direction was passed for recommending the candidate subject to availability of matching vacancies.

Keeping in mind the jobless condition of the petitioner and the fact that he qualified in the selection process and recommendation letter was issued in his favour and in line with the direction passed by the Hon'ble Division Bench in Arpita Pramanik & Ors. (supra), the Commission is directed to recommend the petitioner only if matching vacancy is available after filling up of the vacant 1242 posts.

The writ petition is disposed of.
