Bithie Chatterjee v. State Of West Bengal & ANR
05.07.2022 Item No. 46 Ct. No.40 Ali.
CRR 3925 of 2012 Bithie Chatterjee vs.
The State of West Bengal & Ors.
Mr. Pravash Bhattacharjee Mr. Pratick Bose, ... for the State None appears on behalf of the petitioner.
Mr. Bhattacharjee, along with Mr. Pratick Bose, learned Counsels appear in this case.
The instant application is directed against the order dated 31.08.2012 passed by the learned Additional Sessions Judge, 4th Court, Barasat, North 24-Parganas in Criminal Revision No. 93 of 2011 whereby the Revisional Application was dismissed and the original order passed by the Chief Judicial Magistrate North 24Parganas at Barasat in Case No. C-850 of 2008. There are concurrent findings of two courts. It is no longer res integra that except in exceptional circumstances, the High Court shall not interfere into concurrent findings of the two Courts below.
In the instant case, neither is there any perversity in the order, nor any glaring error causing miscarriage of justice. Therefore, the impugned order demands no interference of this Court.
The instant application, accordingly, stands dismissed on merit.
