Petitioner is a student of B.A. LL.B (5 years) at Shyambazar Law College under the University of Calcutta.

It is the grievance of the petitioner that though he had appeared in fourth semester and sixth semester examinations, his results were not published. Mr.

Nilotpal Chatterjee, learned Advocate appearing for Calcutta University submits that the College has reported before the University that the petitioner, during the pandemic period, did not upload his answer script of the fourth semester examination within the due date. He uploaded his answer script belatedly, long after the due date. As such, the university did not accept the answer script of the said examination.

With regard to publication of the sixth semester examination result, it has been submitted by the university that though the petitioner had uploaded his answer script within the due date, the college authority did not forward the same within the stipulated period of one month from the date of examination.

The College is not represented.

The petitioner could not have uploaded the fourth semester answer scripts long after the publication of the question paper. It, however, appears that he was not at fault for the belated submissions of answer script of the sixth semester examination.

In view of the aforesaid, this writ petition is disposed of with a direction upon the university to publish the sixth semester result incorporating the marks as provided by the College within a period of one month from the date of communication of the order. Insofar as the fourth semester examination is concerned, the petitioner should be allowed to take the said examination as a supplementary examination, as per the relevant rules of the university.

With the above directions, the instant writ petition being WPA 28605 of 2023 is disposed of (Kausik Chanda, J.)
