For the State The writ petitioner is the daughter of a freedom fighter who was drawing pension under Freedom Fighters Pension Scheme.

Previously the widow of the freedom fighter had been drawing freedom fighters pension. The mother of the petitioner expired on 6th September, 2021, whereupon the petitioner made an application along with requisite documents including a 'no objection' affidavit from her brother. In spite of such application being made, some time in 2022, the concerned authority, the respondent no. 2 herein has not responded to such application made on 8th April, 2022 and the matter has been kept pending since.

The petitioner submits that she is a lady under great stress, both financially and emotionally and is entitled to such pension.

The petitioner further submits that as a beneficiary acknowledged by the disbursing authority, she is entitled to such pension.

There has been a long quietus from the respondent no. 2.

The respondent no. 2 is directed to consider the application of the petitioner and dispose of the same, upon considering requisite documents that are required to be submitted by the petitioner, within December 15, 2025.

The concerned respondent shall communicate such order to the petitioner immediately.

Since the respondents have not used any affidavit, the allegations contained in the petition are deemed not to have been admitted.

There shall, however, be no order as to costs. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
