1. The petitioner is aggrieved that the death benefits of her husband who was a former professor of respondent no. 1 has not been given to her nor her claim to be appointed on compassionate ground been considered by the respondent no. 1.

2. Mr. Chaudhuri appearing for the respondents submits that several reminders were given by the university to the petitioner to bring forth requisite document to consider her representation.

In addition thereto, it is also pointed out that there is no scheme in the statute governing the university, for appointment on compassionate ground.

3. It has also been pointed out that the nominee of the former professor, who has since expired is the person entitled to receive a death benefit. The nominee, in the present case is the mother of the professor and not the petitioner, who is the wife.

4. All such points are kept open to be considered by the respondent no. 3 on the basis of the writ petition filed herein, the report filed by the respondent nos. 1 to 3 along with the exception thereto, filed by the petitioner. The petitioner is also at liberty to produce server copies of the orders annexing the present status of the pending litigations between the petitioner and her late husband at the time of hearing before the respondent no. 3.

5. Respondent no. 3 is thus, directed to consider the aforestated documents and dispose of the representation of the petitioner by February 15, 2026 and intimate the result of such consideration to the petitioner immediately.

6. Respondent no. 3 will be at liberty to call for any further document, if he so deems fit.

7. With the aforestated direction, the writ petition is disposed of.

8. However, there shall be no order as to costs.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
