The bail application is pending since December 12, 2024. It was heard on merits by the Co-ordinate Bench on February 5, 2025.

Bail applications filed up to December 31, 2024 were assigned to this Bench by The Hon'ble Chief Justice in the month of February, 2025.

Subsequent thereto, the matter was taken up on February 24, 2025 when adjournment was made on behalf of the petitioner and granted.

Learned Advocate appearing for the petitioner submits that he did not advance any arguments on

merits on February 5, 2025 before the Co-ordinate Bench. He submits that a prayer for adjournment was made on the ground of assessing the stage of the trial in order to determine as to whether or not to press the application for bail.

Learned Advocate appearing for the petitioner submits that, since the trial is at the fag end, he does not wish to press this application. Therefore, he prays for dismissal of the present application for bail as not pressed.

State is represented.

As noted above, the application for bail is pending since December 12, 2024.

According to the petitioner, the trial is at the fag end and therefore, the petitioner does not wish to proceed with the application.

In such circumstances, we allow the prayer of the petitioner to not press the application.

In the event, renewal prayer for bail is made, no doubt, State will bring to the notice of the Court the conduct of the petitioner.

Hence, CRM (NDPS) 1978 of 2024 is dismissed as not pressed.
