1. The revisional application in CO 4515 of 2025 has been preferred praying for transfer of Title Suit no. 8 of 2024, for cancellation of marriage registration certificate, from the Court of learned Principal Judge, Family Asansol, Paschim Bardhaman to the Court of learned Additional District Barrackpore, North 24 Parganas.

2. The revisional application in CO 4519 of 2025 has been preferred praying

for transfer of Title Suit No. 419 of 2024, for a decree to get back his dues, which he spend during the time of matrimonial relation, from the Court of the learned Civil Judge (Junior Division), 3rd Court, Asansol, Paschim Bardhaman to the Court of the learned Civil (Junior Division), Barrackpore, North Parganas.

3. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that both the Title Suits have been filed in the Asansol Paschim Bardhaman by the husband herein.

4. The wife herein resides at Mohanpur, North 24 Parganas along with her child (60% hearing impaired).

5. Considering the said difficulty of the wife to travel to Asansol Court, on regular basis, when she has a disabled child to look after, this Court relying upon the judgments of the Hon'ble Supreme Court in N.C.V.

4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12) and on consent of both parties, directs

that Title Suit No. 8 of 2024 be withdrawn from the Court of learned Principal Family Asansol, Paschim Bardhaman and be transferred to the Court of learned District Judge, Howrah and Title Suit No. 419 of 2024 be withdrawn from the Court of the learned Civil Judge (Junior Division), 3rd Court, Asansol, Paschim Bardhaman be transferred to the Court of the learned Civil Judge, (Junior Division), 1st Court, Howrah.

6. Learned Courts at Howrah shall proceed with the suit in accordance with law with due notice upon both the parties.

7. Keeping in mind the case of the parties herein, the learned Courts shall be at liberty to permit the parties to appear virtually, if the parties make such prayer.

8. CO 4516 of 2025 with CO 4519 of 2025 are disposed of.

9. Parties to act on the server copy of this order.

10. Let a copy of this order be sent to the concerned Courts for immediate compliance.
