Banerjee) Mr. Saptarshi Bhattacharjee ...for the petitioner Learned advocate appearing for the petitioner, in his usual fairness, submits that through inadvertence, the order passed under Order 22 Rule 10 has been challenged by filing an application under Article 227 of the Constitution of India.

The order impugned being an appellable one, this court is not inclined to entertain this application under Article 227 of the Constitution of India. Learned advocate appearing for the petitioner prays for leave to withdraw this civil revision application with liberty to approach the appropriate forum in accordance with law.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 4295 of 2024 stands dismissed as withdrawn with liberty to the petitioner to approach the appropriate forum in accordance with law.

The learned advocate-on-record shall be permitted to take back the certified copy of the order impugned by replacing the same with a Photostat copy thereof.
