Heard learned counsels for the parties.

The primary allegation of the petitioner is that the private respondents are raising unauthorized construction in the land in question without obtaining a sanctioned plan from the Bidhannagar Municipal Corporation.

Learned counsel for the private respondents submits that the private respondents have obtained a sanctioned plan from the Corporation and has been raising construction in accordance with the same.

Learned counsel for the State submits that upon enquiry, it is found that construction material is lying at the site but no active construction work or engagement of

labour was noticed. There is also no breach of peace or disturbance in the locality.

The petitioner has approached the civil Court with regard to the dispute between the parties in connection with the development of the property in question. In the event the complaint lodged by the petitioner before the police authority on 18th November, 2025 has not been acted upon, the petitioner is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS. In the meantime, the police authority shall maintain strict surveillance in the area in order to ensure that no untoward incident occurs and peace and tranquility are maintained.

The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
