Petitioner(s) Mr. Ayan Basu Mr. Sourav Bera Mr. Sumit Routh ... for the Petitioner(s) Ms. Subhasree Patel Mr. Rajashree Tah ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is a Post-Graduate student of History - who is aged about 23 years, and is in custody for more than one year and six months. Learned advocate also submits that the petitioner has been implicated along with the other boarders and the guard of the hostel who are allegedly involved in assaulting an outsider on the ground of theft. Consequently, the victim breathed his last.

However, the nature of the injuries inflicted was by way of fist and blows along with a cricket bat. Having regard to the age and the period of detention of the present petitioner as also considering that no obstruction has been created in the progress of the trial,

inspite of the objection raised by the State, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Rana Hemram @ Rana Hembram shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM-II, Calcutta.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Kolkata without prior intimation to the learned trial court. If there is any violation of the above conditions, the learned trial court would cancel the bail of the present petitioner without further reference to this Court. Accordingly, CRM(M) 2894 of 2025 is allowed.
