The report reflects that out of the 16 witnesses so cited by the prosecution, seven witnesses have already been cross-examined.

The case was registered in the year 2019. More than four years have passed since the initiation of the instant case.

The ld. Special Court under POCSO Act, Berhampore, Murshidabad, is directed that henceforth, a schedule be

fixed consisting of three dates and once in a month such schedule must be fixed.

All efforts must be taken for ensuring the appearance of all the witnesses whom the prosecution intends to rely. Ld. Public Prosecutor conducting the case will cooperate with the concerned police authority for service of summons upon the witnesses and also inform the court before fixing a date regarding the availability of the witnesses concerned. No unnecessary adjournment be granted to either of the parties.

If, for any reason, any witness is absent and the reason is not acceptable to the Special Court, in that case, a superior officer of the police in the rank of Superintendent of Police would be communicated for submitting a report before the ld. Special Court regarding the availability of the witness concerned.

Ld. public Prosecutor conducting the case would produce materials, documents and exhibits on the date so fixed for evidence. All stakeholders will cooperate with the ld. trial court to conclude the trial at the earliest. With the aforesaid observations, CRR 4893 of 2023 is disposed of.

Pending application, if any, is also disposed of. Report submitted by the ld. Registrar Genral, High Court, Calcutta reflects that the officer recorded her

appearance on 19.02.2024. Today the police officer is also present in court. Her further appearance before this court is dispensed with.
