It is the case of the petitioner that the Pradhan of 8 No. Krishnapur Gram Panchayat, in collusion with respondent nos. 5 to 7, is constructing a road by encroaching upon a portion of the land owned by the petitioner.

Learned counsel appearing on behalf of the Panchayat, however, submits that the Panchayat has no involvement in the matter and that the dispute is purely private in nature between the petitioner and respondent nos. 5 to 7. It is further submitted before this Court that the Panchayat has not undertaken any initiative for the construction of any road on the plot of land in question.

The private respondents remain unrepresented.

Since it appears that the dispute is essentially civil in nature between the petitioner and respondent nos. 5 to 7, it would not be appropriate to adjudicate the same in exercise of writ jurisdiction.

Accordingly, WPA 29726 of 2025 is dismissed.

The petitioner shall, however, be at liberty to approach the competent forum for redressal of his grievance.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
