On prayer of the petitioner, liberty is granted to implead Mr. Masidul Islam as respondent no.7 in the writ petition.

The cause title of the writ petition be amended accordingly.

The petitioner is the President of Ratanpur Milan Mela Committee and intends to organise the fair from this day, i.e., 23rd December, 2025 to 7th January, 2026 in the private land belonging to one Abu Bakkar Siddiqui. The said owner issued a no objection in favour of the petitioner to organise such fair in his land. Upon obtaining requisite permissions from the relevant authorities, the petitioner approached the police authority for such permission. No response has been received by him.

Learned counsel for the private respondent submits that the fair has already started from yesterday.

Learned counsel for the State submits that the police authority has no objection to such fair subject to requisite permission being given by the relevant authorities. In view of the above, the writ petition is disposed of permitting the petitioner to organise the fair in the ground owned by one Abu Bakkar Siddiqui from 23rd December, 2025 to 7th January, 2026 subject to compliance with requisite formalities and obtaining permission from the relevant authorities. The fair shall be closed down at 10 pm. every day. The sound system in the fair shall be used in terms of the Government regulations. The fair shall not disturb the neighbours and the public at large in any manner whatsoever and shall not cause any disruption to free flow of traffic. Sufficient police personnel shall be deployed in and around the place in order to ensure maintenance of law and order and also that the visitors to the fair do not spill over to the adjoining roads. No inciteful speech shall be permitted and no immoral/illegal activity shall take place in the fair.

With the above directions, the writ petition is accordingly disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
