CAN 1 of 2024 Affidavit in opposition filed by the petitioner is taken on record.

Since none appears for the applicant on call the application, being CAN 1 of 2024 is dismissed for default. There shall however, be no order as to costs. WPA 28669 of 2023 Heard learned counsels for the parties.

The petitioner applied for issuance of permanent stage carriage permit and offer letter was issued in his favour on 30th October, 2023 pursuant to the resolution taken by the RTA, Purba Burdwan on 16th September, 2023. The petitioner purchased a new BS-VI compliant stage carriage and has complied with all requisite formalities despite which the permit has not been issued in his favour. The petitioner submitted a representation before the concerned authority on 1st December, 2023 requesting issuance of permit which is yet to be considered. The petitioner prays for a direction upon the concerned

authority to consider the representation and issue permit in his favour at the earliest.

Learned counsel for the respondents submit that the 3rd respondent be directed to consider the representation submitted by the petitioner and take necessary steps in terms of the offer letter in accordance with law. In view of the above, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the representation submitted by the petitioner dated 1st December, 2023 and take necessary steps in terms of the offer letter issued in his favour on 30th October, 2023. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The entire exercise is expected to be completed within one month from the date of communication of this order.

With the aforesaid directions the writ petition is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
