On prayer of the petitioners, liberty is granted to correct the address of the 5th respondent in the cause title, plot numbers in paragraph 2 of the writ petition and prayer (a) of the writ petition.

Affidavit of service filed on behalf of the petitioners is taken on record.

None appears on behalf of the private respondents despite service of notice.

Report submitted on behalf of the State respondents is taken on record.

Heard learned counsels for the parties.

The petitioners claim to be the recorded owners of the plot in question and submit that the private respondents have raised unauthorised construction by encroaching upon PWD road adjoining their plot, thereby obstructing their egress and ingress.

It appears from the report submitted on behalf of the State respondents that pursuant to the representation submitted by the petitioners before the concerned authority

in this regard on 4th December, 2023, demarcation of the plot in dispute was made by the Block Land & Land Reforms Officer and upon such demarcation, the Assistant Engineer, PWD, Contai Sub-Division has been requested to evict the encroachers from the plot. The report further states that the eviction drive is likely to be completed by end of August, 2024.

In view of the above, nothing further remains to be adjudicated in the writ petition and the same is accordingly disposed of.

There shall however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
