Mr. Abhinaba Dan, Ms. Sreemoyee Datta ...for the petitioner Mr. Maloy Singh, Mr. Tapas Ballav Mandal The present writ petition has been filed seeking direction against the respondent to restore pond in its original position which is situated at Mouza- Aguribandh Punisole, J.L. No.55, Khatian No.1402, Plot No.514/1924 within Police Station - Onda, District- Bankura.

It is the case of the petitioner that the pond has been illegally filled by some miscreants and he prays for the restoration of the pond to its original condition.

The petitioner has made several representations to the authority concerned. All the representations of the petitioner have fallen on deaf ear of the authority. Petitioner has been made to run from pillar to post without addressing his grievance. The petitioner had also sent a legal notice to the District Magistrate on 3.4.2023 for restoration of the pond to its original position.

Since the District Magistrate has failed to act he is hereby directed, to decide the representation of the petitioner within four weeks and pass a speaking order thereafter affording an opportunity of hearing to the petitioner.

Needless to state that the petitioner shall be at liberty to approach this Court if his grievances are not met with or he is aggrieved by the order passed by the District Magistrate.

The present writ petition is disposed of in the above terms.
