In view of the order passed in CAN 1 of 2023 in MAT 2455 of 2023 with CAN 1 of 2023 in MAT 2456 of 2023 and also having regard to the fact that the applicant stands on the same footing as that of the applicant, who have applied for addition of party, we dispose of the said application with the same observation made in paragraph 13 of our order in MAT 2455 of 2023 (Dibyendu Paul & Ors. vs. Ramesh Malik & Ors. on 20th December, 2023.
