Kausik (Rejected) CRM (M) 2897 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bamongola Police Station Case No. 99 of 2022 dated 10.04.2022 under sections 313/304/120B/34 of the Indian Penal Code, 1860 read with section 6/21 of the POCSO Act, 2012.

Trial of the present case is for murder and penetrative sexual assault of a minor. The post-mortem report reflects the nature of the injuries and pain suffered by the victim. Learned advocate for the petitioner submits that petitioner is in custody for 2 years and 6 months. I have considered the case diary as well as evidence which has already been deposed before the learned Special Court. However, having regard to the gravity and heinousness of the present offence I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 2897 of 2025 is dismissed.

Learned Trial Court is directed to expedite the process of trial.
