Affidavit-of-service filed by the petitioner be kept with the record.
Learned advocate appearing for the petitioner submits that petitioner is in custody for about 55 days and the charge-sheet having been submitted, petitioner may be released on bail on any stringent conditions.
Learned advocate for the de-facto complainant is present. Learned advocate for the State has produced the Case Diary. I have taken into account the statement of the victim under Section 183 of the BNSS. At this stage, I am not inclined to accede to the prayer for bail of the petitioner, as such the same is rejected.
Accordingly, the prayer for bail of the petitioner in CRM (M) 45 of 2026 is dismissed.
Petitioner would renew his prayer for bail after the evidence of the victim under Section 35 of the Indian Evidence Act. Learned Special Court would give priority for fixing the date of evidence preferably within a period of 45 days from the date of consideration of the charges.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
