Ganguly, learned advocate appearing on behalf of the petitioner, contends that Maniktala P.S. Case No.

of dated 23.09.2024 was

initiated as a counter-blast to Dakshineswar P.S. Case No. 66 of 2024 dated 06.05.2024 under Sections 498A/406 of the IPC.

Learned advocate submits that the respondent no.5 happens to be a sergeant employed with the Kolkata Police, as such, he has exerted his influence in registering the aforesaid case.

On the other hand, learned advocate appearing for the private respondent(s), produces medical documents in support of the contentions which is the foundation of Maniktala P.S. Case No.

142 of 2024. Learned advocate also submits that the petitioner no.2 is a Nurse working at Sagar Dutta Medical College & Hospital.

Having considered the fact that there are medical documents which were the genesis for initiating the case by the

Maniktala Police Station, the contentions of counter-blast, at this stage, cannot be considered, as such, I am not inclined to interfere at the investigation stage.

However, the petitioner would be at liberty to approach this Court after the report under Section 173 Cr.P.C. and/or under Section 193 of the BNSS is filed.

With the aforesaid observations, WPA 30032 of 2024 is disposed of.
