Mr. Prantick Ghosh Mr. Prasad Bhattacharyya ....for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff and is directed against an order dated September 26, 2024 passed by the learned Additional District Judge, 11th Court at Alipore, District-South 24-Parganas in Original Suit No.17 of 2021.

By the order impugned the prayer of the petitioner praying for permission to adduce the evidence of the attesting witness prior to the evidence of the petitioner stood rejected.

The learned trial judge rightly took note of the provisions under Order 18 Rule 3A of the Code of Civil Procedure and after taking note of the statements made in the application praying for permission rightly observed that the plaintiff has not explained in his petition the reasons why he is seeking such permission.

This Court does not find any infirmity in the order impugned warranting interference under Article 227 of the Constitution of India.

Accordingly, CO 4303 of 2024 stands dismissed. There will be no order as to costs.
