1. Affidavit of service, as filed, be kept with the record.

2. The petitioner is aggrieved by the respondent holding on to the petitioner's property illegally, unlawfully since expiry of the lease sometime in 1998.

3. Mr. Roy, learned senior Advocate, appearing for the petitioner submits that in spite of there being a representation made sometime in June 2023, the respondents have not only ignored the representation, but have also not taken steps to hand back possession of the property to the petitioner or take steps to make payment of the outstanding lease rentals till 1998. Mr. Roy has also indicted from the petition and from the supplementary affidavit filed on behalf of the petitioner that the respondents are not in possession of the premises and the premise is suffering from years of non-use, non-maintenance and no charges in respect thereof on account of statutory outgoings is being borne by the respondents.

4. Mr. Bhattacharya, learned Advocate representing the respondents, submits that this is completely a private dispute and ought to have been filed before the

P a g e | 2 appropriate Civil Court for adjudication thereof. He has also handed up a copy of Memo No.

PMG(SB)/Bldg/L-271/Manikpara dated 19.11.2025, by which the authorities have approved the lease of the property for a further period, on certain terms and conditions. Though Mr. Bhattacharya has fairly admitted that such proposal has not yet been placed to the petitioner. The copy of the afore-stated memo be kept with the record.

5. In the meanwhile, Mr. Bhattacharya submits that the concerned respondent no. 4 will dispose of the representation dated 22.06.2023 by 20.12.2025 and intimate the petitioner accordingly.

6. With these observations, WPA 30577 of 2024 is disposed of. No order as to costs.
