Learned advocate appearing for the petitioner submits that pursuant to the order passed in CRR 1120 of 2019, the petitioner preferred an application under Section 173(8) of the Code of Criminal Procedure before the learned jurisdictional court and it has been submitted that the jurisdictional court refused to accept the same. The document which has been annexed by way of an application under Section 173(8) of the Code of Criminal Procedure along with the revisional application is not inspiring this Court to pass any order on oral submissions. None of the ordersheets also reflects that such an application was preferred. However, in larger interest of justice, if an application under Section 173(8) of the Code of Criminal Procedure is filed, the learned trial court, as earlier directed in CRR 1120 of 2019, would consider the same in accordance with law without disturbing the smooth progress of the trial.

With the aforesaid observations, the revisional application being CRR 4910 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
