Petitioner has claimed herself to be owner of the property but is unable to enjoy the property because of the act and action of the private respondents.

According to the petitioner she has established her right in different forum, yet as police assistance has not been rendered she is unable to enjoy the property.

Learned advocate appearing for the state has submitted a report.

Report reflects that the respondents have filed Misc. Case before the learned Civil Judge, Senior Division (2nd Court), Krishnanagar being Misc. Case No. 14/2024 which is still pending.

In case the petitioner intends to establish her right or implement the established right by way of seeking police assistance, necessary prayer be advanced before the civil court. In case the civil court passes any direction, police authorities would respect, obey and implement such order. In the meantime, police authorities would keep a strict vigil and would ensure that no breach of the peace takes place and/or any untoward incident results because of the inimical relationship between the petitioner and the private respondents.

With the aforesaid observations WPA 30087 of 2024 is disposed of.

Report submitted by the state be kept with the record. A copy of the report be submitted to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
