Mr. Ghosh, learned Senior Advocate appearing for the petitioners draws the attention of the Court to the bipartite agreement/settlement of revision of payscale and service condition of the employees of the bank and submits that the pay-scale of the employees of the bank should be revised as the cooperative bank

is running with accumulated profit. Mr. Ghosh submits that a representation praying for revision of the pay-scale has been submitted before the Special Officer of the Bank but no decision on such representation has been communicated to the petitioners till date.

Mr. Bhattacharya, learned advocate appearing for the Bank submits that any decision on revision of pay-scale has to be with the approval of the Registrar. Mr. Roy, learned Senior Advocate appearing for the respondent nos. 2 and 5, submits that the question of approval shall arise once a decision is taken by the Bank and the same is forwarded before the competent authority for its approval.

Since a prayer for revision of pay-scale has been submitted before the competent authority, such authority is duty bound to consider the same and take a decision on such prayer.

Therefore, without entering into the merits of the claims made by the petitioners in this representation dated April 5, 2023, followed by several reminders, this writ petition stands disposed of by directing the Special Officer, The Krishnagar City Co-operative Bank, being the respondent no. 4

herein, to consider the representation of the petitioner dated April 5, 2023 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the authorized representative of the writ petitioners and communicate the reasoned order to the petitioners as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order along with a copy of the representation dated April 5, 2023.

Needless to mention that the decision taken on the representation shall be forwarded to the competent authority in accordance with the relevant provisions.
