Kausik (Rejected) CRM (M) 2901 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Saktipur Police Station Case No. 299 of 2024 dated 1st December, 2024 under Sections 126(2)/103(2)/118(2)/109(1)/3(5) of the BNS, 2023. And In the matter of : Sidhu Ghosh @ Siju Ghosh ......Petitioner.

Learned advocate appearing for the petitioner submits that he is in custody for 2 months and 26 days. Similarly placed other accused persons have been granted bail and presently witness action has already commenced after the petitioner surrendered before the learned Trial Court. Learned advocate for the State as well as the defacto complainant opposes the prayer for bail. State submitted that petitioner's prayer for anticipatory bail was rejected as also the same prayer being rejected by the Hon'ble Apex Court.

Attention of the Court was drawn to the statement under Section 183 of the BNSS of the eye witness who is the son of the deceased.

Having considered the petitioner's complicity as narrated in such statement, I am not inclined to release the petitioner on bail at this stage.

As such the prayer for bail of the petitioner is rejected. However, the learned Trial Court is directed to expedite the trial and give priority to the 14 witnesses who are no way connected with the Government Departments.

It has been informed that 5 witnesses have been examined. Rest of the 9 witnesses be examined within the period of 4 months.

Petitioner would renew his prayer for bail after the said period is over.

Accordingly, CRM (M) 2901 of 2025 is rejected at this stage.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
