Affidavit-of-service filed in Court today is taken on record.

The petitioner prays for a direction upon the Prescribed Authority under Section 213A of the West Bengal Panchayat Act, 1973 being the Block Development Officer, Chanchal-I Development Block, Malda to dispose of the application filed by the petitioner on 11th September, 2023.

According to the provisions of law, the time period within which the said application ought to have been decided and disposed of, is long over.

In view of the above, the instant writ petition is disposed of by directing the respondent no. 3 to take immediate steps for disposal of the application filed under Section 213A(7) of the Act at the earliest, but

positively within a period of four weeks from the date of communication of this order.

Learned advocate appearing for the petitioner is directed to forward a copy of the application made under Section 213A (7) of the Act to the aforesaid respondent at the time of communicating the order of the Court.

It is made clear that this Court has not entered into the merits of the said application and all points are left open to be decided by the aforesaid respondent at the time of consideration of the application of the petitioner.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
