Learned advocate appearing for the petitioner submits that although the subject matter of the case relates to 10,000 bottles of Phensedyl, but so far as the present petitioner is concerned only 40 bottles were recovered from an abundant place when the petitioner is taken in custody. Learned advocate for the State has produced the case diary and referred also to the antecedents of the present petitioner.

I have taken into account the totality of the circumstances and I am of the view that the principles of

Section 37 of the NDPS Act do deter the Court from granting bail at this stage.

Petitioner would be well advised to approach this Court at the appropriate stage.

Consequently, CRM (NDPS) 1735 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
