The writ petition was preferred in the month of December, 2024 and accommodation has been prayed for. However, on perusal of the writ petition, I find that there were earlier orders passed in W.P.No. 28696 (W) of 2008, W.P. 19696(W) of 2015 and WPA 2867 of 2020. The petitioner has informed the police authorities on 31.07.2024. The subjectmatter of the disputes relates to a water-body along with the adjoining land.

As none appears on behalf of the State, Mr. Diptendu Narayan Banerjee, learned advocate along with a junior of his choice is directed to represent the State. Their appointment may be regularised by the concerned authorities.

In view of the fact that the information sent to the Inspector-in-Charge, Gangarampur Police Station was on 31.07.2024 and substantial time has passed, if the police authorities till date has not taken any action, they will consider the information furnished and communicate regarding the steps taken to the informant.

Needless to state that this court has not directed to find out whether it is cognizable offence or non-cognizable offence. The police authorities would exercise their discretion as to whether any offence at all has been made out after conducting an enquiry and exercise their powers in accordance with law.

With the aforesaid observations, the writ petition being WPA 30181 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
