The son of the petitioner, who was an assistant teacher in a school, died-in-harness on December 22, 2023. The petitioner being the mother of the employee has approached this Court seeking for payment of her share of the death-cum-retirement benefit.

A representation from the petitioner to the Commissioner of School Education and the District Inspector of Schools (SE), Birbhum is pending consideration for a considerable period of time.

Without entering into the merits of the claim of the petitioner, the instant writ petition stands disposed of by directing the DI of Schools (SE), Birbhum to take a decision on the prayer of the petitioner for releasing her share in the terminal dues of the deceased employee in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order.

An opportunity of hearing shall be granted to

other legal heirs prior to passing the final order in the matter. Any amount that is found due and payable shall be disbursed to the heirs of the deceased.

Learned counsel for the petitioner shall forward a copy of the representation seeking payment along with all other necessary documents to the said respondent at the time of communicating this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
