Learned counsel appearing on behalf of the petitioners hands up a copy of a Notification No. 756I.P./1A-03/14(Pt-II) dated February 25, 2016 issued by the Land and Land Reforms Department, Land Policy Branch, Government of West Bengal (hereinafter referred to as "the said Notification") which is taken on record. The petitioners' case is that the State Authorities acquired and utilised plot of land of the petitioners for the purpose of construction of road but no compensation for the same has been granted to the petitioners. In view of the said Notification stated earlier, the petitioners are agreeable to the proposal of the Government for direct purchase of the land in terms of the said Notification.
Upon considering the submissions made by the learned counsels appearing on behalf of the parties and
the said Notification under reference, respondent no. 4 is directed to deal with the matter and consider the proposal for direct purchase of the land of the petitioners utilised for the purpose of construction of road in terms of the said Notification.
Such exercise should be completed within four months from the date of communication of this order, after affording reasonable opportunity of hearing to all the affected parties including the petitioners, in accordance with law.
With the above observations and directions this writ petition being WPA No. 29858 of 2016 is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
