1. By way of filing this public interest litigation the petitioners allege that the private respondents are putting up illegal construction by encroaching a water body. In this regard a representation has been made, in particular, to the fourth respondent.

2. The learned advocate for the third respondent on written instruction submitted that the land in question does not fall within the jurisdiction of Rampurhat-I Development Block.

The said submission is placed on record.

3. Considering the relief sought for, there will be a direction on the fourth respondent to consider the petitioners' representation and cause a surprise inspection of the premises and if any illegality is found appropriate action be taken against the 8th respondent in accordance with law. The petitioner is directed to forward a copy of the representation along with a copy of the order to the fourth

respondent for compliance of the above direction. The above direction be complied with within a period of three weeks from the date on which the representation is submitted by the petitioner.
